a young woman is walking home at night when a large man jumps out from behind some bushes and verbally threatens her. which type of intentional tort does this represent? a.) assault and battery b.) battery only c.) this action does not rise to the level of an intentional tort. d.) assault only

Answers

Answer 1

A young girl is taking walk home at night when a massive man jumps out from the back of a few trees and verbally threatens her. The sort of intentional tort does this constitute option D.assault only

option D. assault only

Common intentional torts are battery, assault, fake imprisonment, trespass to land, trespass to chattels, and intentional infliction of emotional misery.

The attack is the act of intentionally growing a reasonable apprehension of damage in the direction of another person. for example if Bob waves his fist at we and yells “I'm going to kill you!” this would be taken into consideration as an attack despite the fact that Bob by no means touches us. If he waved a deadly weapon at me, it might be an irritated assault.

Answers

Answer:

The 1920s were a period of optimism and prosperity – for some Americans.  When Herbert Hoover became President in 1929, the stock market was climbing to unprecedented levels, and some investors were taking advantage of low interest rates to buy stocks on credit, pushing prices even higher.  In October, 1929, the bubble burst, and in less than a week, the market dropped by almost half of its recent record highs.  Billions of dollars were lost, and thousands of investors were ruined.

After the stock market crash, President Hoover sought to prevent panic from spreading throughout the economy.  In November, he summoned business leaders to the White House and secured promises from them to maintain wages.  According to Hoover’s economic theory, financial losses should affect profits, not employment, thus maintaining consumer spending and shortening the downturn.  Hoover received commitments from private industry to spend $1.8 billion for new construction and repairs to be started in 1930, to stimulate employment.

The President ordered federal departments to speed up their construction projects and asked all governors to expand public works projects in their states. He asked Congress for a $160 million tax cut while doubling spending for public buildings, dams, highways, and harbors.

Praise for the President’s intervention was widespread;  the New York Times commented, “No one in his place could have done more. Very few of his predecessors could have done as much.”  Together, government and business spent more in the first half of 1930 than in the entire previous year. Still consumers cut back their spending, which forced many businesses and manufacturers to reduce their output and lay off their workers.

In October 1930, with unemployment rising, Hoover created the President’s Emergency Committee for Employment (PECE) to coordinate state and local relief programs, and to develop methods for increasing employment in the private sector.  But with no direct control of funding for relief or jobs, PECE had only limited success.

As the Depression worsened, Hoover requested that the Federal Reserve increase credit, and he persuaded Congress to transfer agricultural surpluses from the Federal Farm Board to the Red Cross for distribution to relief agencies. Hoover asked Congress for even more spending on public works, and he continued to encourage states and private businesses to generate new jobs.

Economic conditions improved in early 1931 until a series of bank collapses in Europe sent new shock waves through the American economy, leading to additional lay-offs.  In August 1931, PECE was reorganized as the President’s Organization on Unemployment Relief (POUR). POUR expanded on PECE's work but also implemented a national fund drive for unemployment relief.  The national fund drive raised millions of dollars but proved to be woefully inadequate as unemployment soared to record levels.

Hoover was criticized for almost every program he proposed.  His public works projects, designed to create jobs, were characterized as wasteful government spending.  His efforts to promote local relief programs, rather than asking Congress to create nationwide relief programs, were viewed as callous disregard for the unemployed.

in the study depicted in the figure above, how could a researcher transform the study into a within-groups design?

Answers

In the study shown in the figure below, the researcher could transform the study into a within-group design such that participants play both a competitive game and a non-competitive game. Here option C is the correct answer.

The study depicted in the figure above is a between-group design, where the participants are assigned to one of two groups: the competitive video game group or the non-competitive video game group. To transform this study into a within-group design, the researcher would need to have all participants play both competitive and non-competitive video games.

Option C, "Having participants play both the competitive game and the noncompetitive game," is the correct answer. By having participants play both games, the researcher would be able to compare the participants' blood pressure levels during the competitive game to their blood pressure levels during the non-competitive game. This would allow the researcher to control for individual differences in blood pressure levels and other potentially confounding variables, which could affect the results.

If the researcher were to add a control group (option A), this would not transform the study into a within-group design, but rather, into a between-group design with an additional control group. Similarly, removing the first blood pressure measurement (option B) would not transform the study into a within-group design, but rather, would simply remove the pre-test blood pressure measurement.

Answers

Abdullah et al. (2020) has examined the wage differentials that exist between natives and immigrants in the Malaysian labor market. The study has explained the wage differentials along with the income distribution and the causes of wage differentials in Malaysia.

Wage differentials are determined by a range of factors, which include economic, social, cultural, and policy-related factors. In Malaysia, the study has identified that there is a difference between the wages of native and immigrant workers. The study has shown that immigrants earn less than natives, even if they possess the same education and work experience. The wage differential could be due to a range of reasons, such as discrimination, differences in human capital endowment, and immigration policies. The study has indicated that labor migration policy in Malaysia plays a significant role in the wage differentials between natives and immigrants.

The government of Malaysia has been adopting policies that encourage immigrant workers, such as offering low-skilled workers to fill labor shortages in Malaysia. As a result, the low-skilled native workers are being replaced by the low-skilled immigrant workers, which could have caused the wage differential between natives and immigrants. In conclusion, the study has identified that there are wage differentials that exist between natives and immigrants in the Malaysian labor market, which could be due to several factors such as discrimination, human capital endowment, and immigration policies.

How is the use of Integrated Marketing Communications an essential tool in the twenty-first business landscape?

Answers

Integrated Marketing Communications (IMC) is an essential tool in the twenty-first century business landscape for several reasons.

Firstly, IMC ensures consistent brand messaging across various communication channels, which strengthens brand identity and builds customer trust. As Keller and Kotler (2016) argue, a cohesive message reinforces brand recognition and enhances customer loyalty. For instance, Nike's "Just Do It" campaign effectively integrated advertising, social media, and athlete endorsements to deliver a consistent message of empowerment and motivation.

Secondly, IMC allows organizations to reach their target audience through multiple touchpoints, increasing brand visibility and customer engagement. In today's digital age, consumers are exposed to numerous marketing messages, making it crucial for companies to have a comprehensive and integrated approach. By leveraging various channels such as social media, email marketing, and content creation, companies can effectively connect with their audience at different stages of the customer journey.

Lastly, IMC enables companies to optimize their marketing efforts and achieve better results. By integrating different communication channels, organizations can track and analyze data more effectively, allowing them to refine their strategies and allocate resources efficiently. This data-driven approach enables businesses to make informed decisions, personalize their messaging, and ultimately drive better business outcomes.

1. The high rate of technological change in many industries has created new sources of value for customers.

2. Strategic pricing requires anticipating price levels before beginning product development.

3. Cost-plus pricing leads to overpricing in weak markets and underpricing in strong ones.

4. A successful pricing strategy must justify the prices charged in terms of the value of the benefits provided.

5. When the goal is not to maximize value capture but to rely instead on low "value pricing" to attract customers.

This is because technology is constantly evolving, and new developments can lead to new products and services that provide greater value to customers.

This involves considering the costs of production, the prices of similar products on the market, and the value that customers will place on the product.

This is because cost-plus pricing involves setting a price based on the cost of production plus a fixed markup. In weak markets, this can lead to prices that are too high and discourage customers from buying. In strong markets, this can lead to prices that are too low and leave money on the table.

This means that the price should reflect the value that customers will receive from the product or service, and should be based on factors such as the quality of the product, the features it offers, and the level of customer support provided.

This involves setting a lower price in order to attract customers who are looking for a good deal, and is often used by companies that are trying to gain market share or compete with lower-priced competitors.

No sample has been sent for analysis nor has the atmosphere inside the vessel been checked for a flammable vapour. It is thought that the material is thermally stable tar. The unofficial plan is to apply steam to the bottom steam-heated battery, in order to soften the sludge, which is unevenly distributed about the tanks bottom and estimated to have a maximum depth of 35 cm (15 in).
