Using the scenario below, discuss jury selection and race and gender issues within
that process. Should attorneys be allowed to select or strike jurors based on either
race or gender? What potential effect does this have on our system of justice?
Which is more important: the right to trial by an impartial jury or the need for
secrecy in jury deliberations? (Explain in at least 300 words)

Scenario: Several years ago, following the conviction of Miguel Angel Pena-Rodriguez
for attempted sexual assault, a juror showed bias during deliberations. Among other
things, the juror said, “I think he did it because he’s Mexican and Mexican men take
whatever they want.” Even though jury deliberations are meant to be kept secret,
Rodriguez’s lawyers wanted the statements made public and demanded that their client
be retried by an unbiased jury.

Answers

Answer 1

In the scenario, It is a case of juror bias towards a specific ethnicity ,' Mexicans" as referred below.

Due to a perceived lack of justice in a jury trial, the contentious topic of racial and gender prejudice in jurors is brought up.

1. Should lawyers be permitted to choose or exclude jurors based on their color or gender?

When the court determines that a prospective juror cannot decide the case impartially, they are excused "for reason" during the jury selection process. Each party may independently employ a certain number of peremptory strikes to dismiss new jurors without providing a justification. But, the U.S. Supreme Court has ruled that peremptory challenges cannot be used to systematically exclude potential jurors from the panel on the grounds of race.

2. Potential effect  on our system of justice?

By investigating the impact of race on peremptory challenges and the justifications offered for strikes, a recent study investigated these problems.Furthermore, the study discovered that race-neutral justifications were frequently offered even when peremptory challenges were impacted by race. These results are in line with the psychology of social evaluation, social desirability, and unconscious bias. Our legal system is negatively impacted by this.

3. Which is important: the right to trial by an impartial jury or the need for secrecy in jury deliberations?

In all criminal prosecutions, the accused shall have the right to a speedy and public trial, by an impartial jury of the State and district where the crime shall have been committed, which district shall have been previously determined by law, and to be informed of the nature and cause of the accusation, to be confronted with the witnesses against him, to have a mandatory process for obtaining witnesses in his favour, and to have the Assistance of Counsel for his defense.

Some important points are-

There must be confidence that the jurors selected are fair and willing to judge the case based only on the facts given. The Court has ruled that when a defendant is tried before a jury that is predominantly made up of government employees in the District of Columbia, he is not denied an unbiased jury in the absence of an actual proof of prejudice. Nonetheless, when the jury or any of its members is exposed to pressure or influence that potentially limit freedom of action, a defendant's right to an impartial jury is violated; The trial judge shall hold an inquiry in which the defence is present to establish if impartiality has been compromised. It is necessary to look into jury exposure to potentially prejudiced material and disruptive courtroom behaviour that might undermine impartiality. It is not acceptable to interfere with a jury in any way, including by private messages, contact, or manipulation. A defendant is legally entitled to a change of venue when the area where the trial will take place has been heavily publicized regarding him or her, making it doubtful that he or she would be able to find an impartial jury.

Therefore, a bit of both the right to trial by an impartial jury and the need for secrecy in jury deliberations is important.

What is weakness according to the passage

The idea that women are perpetually in their juvenile years, incapable of standing on their own, and in need of constant protection and flattery is referred to in the passage as frailty. The author contends that this perspective is constrictive and demeaning to women, and that they should work to develop mental and physical toughness.

The author contends that this constricting perspective of women is exacerbated by the conventional characteristics of femininity, such as soft phrases, susceptibility of heart, delicacy of sentiment, and refinement of taste, which are frequently viewed as weakness. The notion that women are fundamentally less valuable than males and incapable of reaching true dignity and happiness in life is thus referred to as weakness in this context.

You are a reporter at the Spindletop strike. Write a short paragraph on the event. Consider the following:

*the people and events that led to the strike
*how the strike will affect the future

(PLEASE HELP ME OUT)

Answers

On January 10, 1901, an enormous geyser of oil exploded from a drilling site at Spindletop Hill, a mound created by an underground salt deposit located near Beaumont in Jefferson County, southeastern Texas. Reaching a height of more than 150 feet and producing close to 100,000 barrels a day, the “gusher” was more powerful than any previously seen in the world. A booming oil industry soon grew up around the oil field at Spindletop, and many of the major oil companies in America, including Gulf Oil, Texaco and Exxon, can trace their origins there.

The Need for More Oil

By the mid-19th century, the tremendous effects of the Industrial Revolution had created a need for a cheaper and more convenient fossil fuel than coal; this need would be filled by petroleum. Edwin Drake drilled the first well specifically intended to extract oil in northwestern Pennsylvania in 1859, and by the end of the century, Pennsylvania had produced more oil than any other state.

Did you know? Today, Texas produces 1,087,000 barrels of oil per day.

As for Texas, Native Americans living in the region had known about the sticky black tar found in the earth there for centuries, and had long used it for medicinal purposes. By the end of the 19th century, several discoveries of oil had been made in the southeastern part of the state, including small fields near Nacogdoches and at Corsicana. In 1900, however, total Texas oil production was 863,000 barrels, a small fraction of the national total of 63 million.

Salt-Dome Speculation

Spindletop Hill, south of Beamount in Jefferson County, was formed by an underground salt dome, which pushed the earth above it higher and higher as it grew. It was the mechanic and self-taught geologist Patillo Higgins who first suspected there might be oil lurking beneath Spindletop (and other similar salt domes). Higgins organized the Gladys City Oil, Gas and Manufacturing Company in 1892 to look into the possibility, though his theory met with widespread skepticism from petroleum and geologic experts. Years later, Higgins ran a newspaper advertisement for fellow investors and got a response from the Austrian-born engineer Anthony F. Lucas, who shared Higgins’ view on the salt domes. When Lucas finally convinced leading Pennsylvania oilmen John Galey and James Guffey to finance a drilling operation, Higgins was completely excluded from the arrangement. (Higgins would later sue, and receive a comfortable profit from the Spindletop oil field.)

Drilling began at Spindletop in October 1900, and by early January 1901 they had reached a depth of some 1,020 feet after overcoming initial difficulties in drilling into the sandy ground. On January 10, mud began bubbling out of the hole. Workers soon fled as the mud came gushing out at high speed, followed by natural gas and then by oil. The Lucas Geyser, as it was called, reached a height of more than 150 feet, and was the most powerful that had ever been seen in the world. It was soon producing close to 100,000 barrels a day, more than all the other oil wells in America combined.

A Booming Industry

Tens of thousands of people flocked to the Spindletop oil field after the strike, transforming southeastern Texas from a sleepy backwater to a bustling boomtown within months. Spindletop in 1901 saw the earliest beginnings of the petroleum company that would become Gulf Oil Corporation (bought by Chevron Corporation in 1984). The oil strike at Spindletop also spawned the oil giants Texaco (founded as the Texas Fuel Company), Amoco and the Humble Oil Company (later Exxon Company USA).

In its first year, Spindletop produced more than 3.5 million barrels of oil; in its second, production rose to 17.4 million. In addition to driving the price of oil down and destroying the previous monopoly held by John D. Rockefeller and Standard Oil, Spindletop ushered in a new era in Texas-based industry, and was enormously influential in the state’s future development. New oil companies were formed, along with the refining and marketing organizations needed to support them, offering a host of new jobs and increased income for the state’s inhabitants. Meanwhile, thousands of new prospectors arrived in Texas, searching for their own fields of black gold.

Lasting Impact

Though the oil boom surrounding Spindletop had largely subsided by the beginning of World War I, its impact would last much longer. The abundance of oil found in Texas would fuel the expansion of the shipping and railroad industries, as well as the development of new innovations such as automobiles and airplanes. By the late 20th century, oil refining, chemicals and petrochemicals continued to dominate Texas industry, though electronics, aerospace and other high-tech fields had increased in importance.

What caused a wave of migration to the United States in 1910?

To flee racial violence, pursue economic and educational possibilities, and win freedom from Jim Crow tyranny was what propelled the mass movement. The United States' involvement in and impacts from both World Wars are sometimes used to divide the Great Migration into two stages.

Black southerners were relocated to northern and midwestern cities during the First Great Migration (1910–1940), notably New York, Chicago, Detroit, and Pittsburgh. More physically fit men were dispatched to fight in Europe as the war effort increased in 1917, leaving their industrial employment unfilled.

We learned about Erikson's sixth psychosocial stage: intimacy versus isolation. Erikson said that people need "concrete affiliations and partnerships," and yet fewer young adults today are getting married or becoming parents, compared to generations before. Based on your understanding of cognitive, emotional, and social characteristics of young adults, why are their intimacy needs so strong? Despite strong needs for intimacy, why do you think fewer are marrying?

Answers

Young adults have strong intimacy needs due to their cognitive, emotional, and social development, but fewer are marrying today due to various factors such as shifting societal norms, increased focus on personal and career goals, financial considerations, and alternative forms of relationships.

Young adulthood is a stage of significant cognitive, emotional, and social development, which leads to strong intimacy needs.

During this period, individuals strive to form deep connections and establish meaningful relationships. Erikson's sixth psychosocial stage, intimacy versus isolation, highlights the importance of developing close affiliations and partnerships during this life stage.

Cognitively, young adults have developed the ability to think abstractly, envision future possibilities, and understand complex emotions. They possess the capacity to engage in reciprocal and intimate relationships, seeking emotional support and shared experiences.

Emotionally, young adults experience a heightened desire for connection and intimacy. They seek companionship, love, and a sense of belonging, desiring emotional intimacy and shared vulnerability with a partner.

Socially, young adults navigate the transition from family-oriented relationships to peer and romantic relationships. They seek to establish their own identities and explore different forms of intimacy, including friendships, romantic partnerships, and long-term commitments.

However, despite these strong intimacy needs, fewer young adults today are opting for marriage compared to previous generations. This can be attributed to various factors. Firstly, societal norms have shifted, and individuals have greater freedom to choose alternative relationship structures or prioritize personal and career goals over marriage.

Financial considerations also play a role, as many young adults face economic challenges, making them more hesitant to take on the financial responsibilities associated with marriage and starting a family.

Additionally, advancements in technology and changing social dynamics have created alternative avenues for connection, such as online dating or cohabitation, which may influence the decision to delay or forgo marriage.

In conclusion, while young adults have strong intimacy needs due to cognitive, emotional, and social development, fewer are choosing marriage today due to shifting societal norms, focus on personal and career goals, financial considerations, and the availability of alternative relationship structures.

It is important to recognize that intimate connections can still be formed and fulfilled through various means beyond traditional marriage.
